Terms of Service

1.This agreement

These terms are an agreement between you and DMChat, Navi Mumbai, Maharashtra, India (“DMChat”, “we”). They cover the DMChat app and dmchat.io, and they replace our old separate website terms. Our Privacy Policy and Refund Policy are part of them. By creating an account you accept these terms. If you use DMChat for a business, you accept them for that business.

2.Who can use DMChat

• You’re at least 18.
• You connect only Instagram professional accounts (Business or Creator) that you own or are allowed to manage.
• The information you give us is true, and you keep it up to date.

3.What DMChat does, and what Instagram controls

DMChat sends replies, DMs and moderation actions on your Instagram account through Meta’s official API, based on the rules you set. Meta decides what that API allows: who can be messaged, when, and how often. Meta can change those rules, review or limit your account, or cut off access without telling us first. We’re a Meta Verified Tech Provider, but we aren’t part of Meta.

We work hard to keep DMChat running, and we’ll tell you about planned maintenance and major outages. We don’t promise any particular uptime.

4.Your account

You sign in with Google. Keep that account secure. You’re responsible for what happens under your DMChat account, including actions by anyone you give access to. Tell us straight away at support@dmchat.io if you think someone else got in.

5.Using DMChat fairly

You agree not to use DMChat to:

• message people who haven’t interacted with your account, or send bulk unsolicited messages
• send anything illegal, deceptive, hateful, sexual content involving minors, or anything that harms or harasses people
• break Instagram’s Terms of Use, Community Guidelines or Platform Terms
• collect people’s data in ways they wouldn’t expect, or use it for anything other than replying to them
• access accounts you don’t control, test our security without written permission, or overload or reverse engineer the service
• resell DMChat, or run it for others, without our written permission

On Influencer, sends above 50,000 DMs a month are paced to protect your Instagram account. We may also slow or pause sends that look likely to get an account flagged.

6.Your content and your audience’s data

You own your messages, links, forms and everything else you put into DMChat. You give us permission to store and use it only to run DMChat for you. You’re responsible for what your automations say, and for having a lawful basis to message people and collect their details. That includes telling people how you use their data, for example with a privacy notice linked in your lead forms. We process your audience’s data only on your instructions, as our Privacy Policy describes.

7.Plans and billing

• Free has the limits shown on our pricing page. When you reach them, automations pause until the next month or until you upgrade.
• Influencer is billed monthly or yearly through Razorpay, in advance, and renews automatically until you cancel.
• Prices in rupees include GST. Prices in dollars may have tax added where the law requires it.
• Cancel any time in Settings → Billing. You keep Influencer until the end of the period you paid for.
• If a payment fails, we’ll email you and retry. If it still fails, your account moves to Free.
• We’ll give you at least 30 days’ notice of a price change. It applies from your next renewal. A founding-creator price stays as long as your subscription doesn’t lapse.

8.Refunds

New paid subscriptions can get a full refund within 7 days. The Refund Policy has the details.

9.Ending things

You can stop any time: cancel your plan, disconnect Instagram, or delete your account in Settings → Delete account.

We can suspend or close an account that breaks these terms, puts Instagram accounts or people at risk, or doesn’t pay. When we can, we’ll warn you first and give you a chance to fix it. If we close DMChat entirely, we’ll give you at least 30 days’ notice and refund any unused prepaid time.

10.Our property

DMChat, its design, code and brand belong to us. You can use DMChat under these terms, and that’s all. You’re welcome to link to any page of dmchat.io, as long as you don’t suggest we endorse you. If you send us ideas or feedback, we may use them without owing you anything.

11.No guarantees

DMChat is provided “as is”. We don’t promise any particular results, like more sales or followers. We also can’t promise that every DM will be delivered, or that Instagram won’t limit your account. This doesn’t affect rights that consumer law gives you and that can’t be excluded.

12.Limits on our liability

As far as the law allows, we aren’t liable for indirect or consequential losses, such as lost profits, lost data or harm to reputation. Our total liability for all claims is limited to the greater of the amount you paid us in the 12 months before the claim and US$50. Nothing here limits liability for fraud, or for anything the law doesn’t let us limit.

13.Indemnity

If someone makes a claim against us because of your content, your automations, or your breach of these terms or of Instagram’s rules, you’ll cover our reasonable costs of dealing with it.

14.Governing law and disputes

These terms are governed by the laws of India. If something goes wrong, please email us first: most things get fixed in a reply. If we can’t settle it within 30 days, the courts of Navi Mumbai, Maharashtra, India have exclusive jurisdiction. If you’re a consumer in the EU or UK, you also keep the protection of your local laws and courts.

15.Changes to these terms

We’ll email you at least 14 days before an important change takes effect. If you keep using DMChat after that, the new terms apply. If you don’t agree, you can cancel and delete your account before then.
